Summary:
This position performs substantive and procedural legal work as authorized by law and by in-house counsel. The Paralegal I will work on litigation and legal compliance matters assigned by management or in-house counsel. The incumbent will provide support as a record’s custodian in witnessing, mediations, depositions, trials, arbitrations, and discovery requests, and investigate and perform account-level reviews and provide recommendations to management and in-house counsel based upon investigation findings. This role reports directly to the Sr. Corporate Counsel or Assistant General Counsel.
Roles & Responsibilities:
Manage several matters as assigned by management within the litigation inventory including receiving, reviewing, investigating, and analyzing each matter and seeking guidance and escalating any issues to management and in-house counsel.
Settle matters with minimal supervision within given settlement authority parameters including ensuring account level obligations are met post settlement.
Research pertinent points of law asserted by opposing counsel or that may affect recovery efforts.
Monitor all matter deadlines in a timely manner.
Process all requests by assigned outside attorneys for media issues, settlement authority, check requests, etc. to bring a suit to resolution.
Witness for law firms as a records custodian at telephonic or at live trials, mediations, arbitrations and depositions. Part of the records custodian function requires the Litigation Paralegal I to comprehend and articulate policies and procedures under oath as needed.
Work with attorneys to schedule or decline appearances. Evaluate which matters justify travel costs.
Work directly with outsourced attorney during briefings to prepare for witness appearance and prepare travel packets for yourself or other witnesses.
Coordinate efforts directly with the firms for efficient and effective responses to all requests for discovery to include interrogatories, admissions, disclosures, and production of documents as well as coordinate with servicers throughout indemnification procedures and processes as required.
Review of discovery responses, affidavits, and verifications for other paralegals if asked by management.
Investigate and research by utilizing various systems within Resurgent, contacting various business lines and subject matter experts, and exploring/examining “holes” that may exist within a process, policy, or procedure that generated a cause of action or could lead to another cause of action.
Research accounts or portfolios for the complete ownership assignment chain from the purchase bill of sale through current owner.
Identify and escalate to Manager any issues that cause liability or are above authority level.
Identify and escalate to Manager any trends that could be systemic or become problematic in future suits.
Collect and process all correspondence received on accounts placed with assigned attorneys.
Ensure that all actions, discovery and witness requests are tracked through case management software, CounselLink, per defined processes.
Assist on any special projects assigned by management and in-house counsel to include training within the legal department.
Other responsibilities as assigned by management.
Skills & Qualifications:
1-2 years of relevant experience required.
National certification by either NALA or NFPA strongly preferred but years of relevant experience may be considered in lieu of certification.
Ability to quickly and accurately evaluate new matters and assess the applicability of relevant statutes, codes, and regulations.
Must possess strong interpersonal and communication skills.
Advanced organizational, analytical, and problem-solving skills with an emphasis on attention to detail.
Demonstrated ability to proactively identify issues and opportunities and address the same with minimal supervision.
Must be able to work on a team or independently with minimal supervision.
Educational Requirements:
High School Diploma or GED required
Four-year college degree preferred
