THE STARTING SALARY FOR THIS POSITION IS LIMITED TO $87,849- $103,184. Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.

This position is located in the Consumer Protection Division.

The primary purpose of the Division is to carry out the Attorney General’s duty to enforce the State’s laws prohibiting unfair or deceptive commercial practices, unfair methods of competition, and combinations and conspiracies in restraint of trade. This Division responds to questions from the general public and state officials relating to consumer matters and mediates many of the complaints received and investigates and litigates violations of law.

The primary purpose of this position is to represent the Department in complex charitable trust modifications and charitable asset transfers and advise the Attorney General and Senior Management on charities matters.

Charitable Trusts and Asset Transfer Review
Monitor and review complex charitable asset transfers and charitable trust modification and termination cases. Review records of corporate actions and review financial and real estate transactions of the greatest complexity in order to make a recommendation to management about what the Department’s decision should be in each transaction.

Research and draft proposed statutes and rules pertaining to charities and other nonprofit issues. Make presentations to the legislative committees or rule making bodies as necessary. Respond to requests for legal opinions from members of General Assembly or other government officials. Respond to public inquiries, including those from the press and local law enforcement officials. Advise and assist other attorneys, specialists and investigators in their duties, including giving appropriate instruction in the law. Assist Division and Section Directors with responding to public concerns and complaints regarding the Department’s regulatory authority. Work with businesses, and business and professional groups, including trade associations, Better Business Bureaus, etc. to develop mechanisms such as best management and corporate practices for nonprofits.

Consumer Protection Investigation and Enforcement
Prepare, file and litigate cases in trial and appellate courts where negotiation of appropriate settlement is not possible and draft and file amicus curiae briefs in private appellate cases or in cases from other states involving important consumer protection issues.

Negotiate settlement of cases as appropriate. Select cases for enforcement activity which will have the most impact on the public. Factors to be considered include the number of complaints, number of victims, harm per victim (monetary or otherwise), likelihood of repetition or continuation, past history of violator, clarity of law violation, violator’s intent, precedential value and likelihood and effectiveness of private or other government action to remedy or prevent violations.

Represent the Attorney General in multi-state and state-federal efforts to investigate and stop deceptive and fraudulent business practices which are nationwide in scope. This function may involve consulting with other states by conference call and in writing, participating in direct negotiations on behalf of other states or coordinating enforcement actions if negotiations fail.

The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the state, state agencies, and elected officials, and defends the rights of the people of North Carolina. The Department handles all state criminal appeals cases and assists district attorneys with complex criminal cases at their request. Additionally, the Department of Justice includes the North Carolina State Crime Lab, the North Carolina Justice Academy, and the Sheriffs’ and Criminal Justice Education and Training Standards Divisions.

The salary grade for this position is LG08. State employees are encouraged to apply for positions of interest even if the salary grade is the same as, or lower than, their current position. If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. Based upon these factors, a pay increase MAY or MAY NOT result.

Qualifications

Knowledge, Skills and Abilities / Competencies

Ability to analyze facts, evidence, and legal instruments.
Ability to express conclusions and arguments clearly and logically in oral and written form.
Ability to analyze legal problems and render formal opinions.
Ability to establish and maintain effective working relationships.

Minimum Education and Experience Requirements

Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience.

NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.

Management Preferences: Experience with nonprofit asset transfers and charitable trusts, charities investigations, and consumer protection litigation.

Applicants seeking National Guard Preference must attach a NGB 23A (RPAS) if you are a current member of the NC National Guard in good standing. If you are a former member of the NC National Guard who served for at least 6 years and was discharged under honorable conditions, you must attach either a DD256 or NGB 22.
