Job Description

Overview:
Friendly Franchisees, a dynamic family-owned business specializing in restaurant operations and real estate ventures, is built on a foundation of trust, collaboration, and entrepreneurial spirit.

As we continue to grow and diversify, we are seeking a highly skilled and experienced Eviction Counsel to join our legal team. The ideal candidate will specialize in landlord-tenant law and possess extensive experience managing eviction processes for residential apartment units. This role involves providing legal support and representation to the company’s property management team, ensuring compliance with applicable laws and regulations while efficiently resolving tenant disputes and eviction cases.

As a key member of our legal team, the Eviction Counsel will collaborate with property managers, leasing agents, and external stakeholders to safeguard the company’s assets and uphold operational excellence in handling tenant-related legal matters.

Key Responsibilities:

Eviction Management:

  • Oversee and handle all phases of the eviction process, including preparing notices, filing legal documents, representing the company in court, and coordinating with local authorities to enforce judgments.
  • Draft and serve eviction notices (e.g., notices to quit, pay rent or vacate, and cure/quit notices) in compliance with local, state, and federal laws.

Legal Compliance:

  • Ensure all eviction proceedings adhere to applicable landlord-tenant laws, including rent control ordinances and fair housing regulations.
  • Keep the company updated on changes in laws and regulations affecting eviction processes.

Litigation:

  • Represent the company in court hearings, mediation, and arbitration involving tenant disputes, unlawful detainers, or lease violations.
  • Negotiate settlements with tenants and their legal representatives when appropriate.

Advisory:

  • Provide legal advice to property management staff regarding tenant disputes, lease enforcement, security deposits, and tenant violations.
  • Review and revise lease agreements, notices, and related documents to ensure compliance with legal standards.

Documentation and Record-Keeping:

  • Maintain accurate records of eviction cases, legal documents, and court proceedings.
  • Prepare detailed reports for management on the status of eviction cases and legal matters.

 

 

 

Collaboration:

  • Work closely with property management teams to address tenant issues proactively and minimize legal risks.
  • Liaise with external counsel and legal service providers when necessary.

Qualifications:

Education:

Juris Doctor (JD) from an accredited law school.

Active membership in the State Bar in CA, Texas and AZ.

Experience:

  • Minimum of 5 years of experience practicing landlord-tenant law, with a focus on residential evictions.
  • Proven track record of successfully managing eviction cases for multi-family or residential apartment units.

Skills:

  • Strong understanding of landlord-tenant laws, fair housing regulations, and eviction procedures.
  • Excellent litigation and courtroom advocacy skills.
  • Exceptional written and verbal communication abilities.
  • Strong negotiation and dispute resolution skills.
  • Highly organized with the ability to manage multiple cases simultaneously.
  • Proficient in legal research tools and case management software.

  • Detail-oriented and proactive in identifying and addressing legal risks.
  • Strong ethical standards and ability to handle sensitive tenant-related issues with discretion.
  • Collaborative mindset with the ability to work effectively with cross-functional teams.

Preferred Qualifications:

  • Experience with large residential property portfolios or multi-family units.
  • Familiarity with rent control ordinances and affordable housing laws.

Salary and Benefits:

Salary Range: $75,000-$110,000

Benefits: Medical and paid time off.
