Description

Responsibilities and Essential Duties:

  • Collaborate with Human Resources (People) function and the General Counsel to investigate, address, and provide advice on various employment law issues.
  • Work closely with Chief Compliance and Privacy Officer to help ensure the Organization is meeting or exceeding its regulatory compliance requirements.
  • Assist the General Counsel in reviewing and analyzing all the Company's business and operations to ensure compliance with Stark, anti-kickback and other fraud and abuse laws, HIPAA, 42 CFR Part 2, and any other applicable regulatory requirements.
  • Work directly with the General Counsel and other team members to identify legal risks and compliance issues arising in day-to-day operations, contractual matters, and business transactions, and providing legal support as assigned by the General Counsel.
  • Counsel management team on proposed arrangements, transactions, and complex legal matters and provide necessary training/education at the direction of General Counsel.
  • Research relevant laws, rules, and regulations for various legal and compliance topics associated with the provision of healthcare and business operations.
  • Assist with the filing of administrative appeals and documentation to health insurers, governmental payers, and government agencies as required by law.
  • Prepare or assist with preparation of agency filings; Prepare or assist with preparation of draft responses to questions regarding procedural issues for agency filings.
  • Prepare licensure applications.
  • Monitor status of proposed legislation and regulations of interest to the Organization including but not limited to regulatory changes and compliance with behavioral health, addiction medicine, telehealth, artificial intelligence, privacy, and policy requirements.   
  • Other projects and duties as assigned.
  • Drafting, revising, reviewing and negotiating contracts, agreements, and policies as assigned.
  • Supports the Mission, Values, and Vision of Community Care of West Virginia and the facility.

  • Follow proper reporting procedures for actual or potential accidents and/or incidents so follow-up and/or prevention can occur.
  • Record/report the need for service maintenance or repair of equipment and remove any faulty equipment from service.
  • Consistently evaluate work and determine if further steps are needed to meet patient expectations.

  • Consistently demonstrate the ability to respond to changing situations in a flexible manner in order to meet current needs, such as reprioritizing work as necessary.
  • Minimize non-productive time and fill slow periods with activities that will enable you to prepare to meet the department's future needs.

Qualifications

Physical Demands/Working Conditions:

  • Work is performed in a professional medical office setting, business casual dress environment.
  • Extended periods of sitting and/or standing, telephone, and computer work.
  • Ability to see information in print and/or electronically.  
  • The job requires standing, walking, hearing, reaching, talking, and occasional lifting up to 25 pounds.
  • Employees will be exposed to viruses, disease, and infection from patients and specimens in the working environment.
  • The employee will be required to work at any facility and be responsible for their own transportation.
  • Employees may experience traumatic situations, including psychiatric, dismembered, and deceased patients.

Education/Training/Experience:

  • Associate’s Degree and Paralegal Certificate (Required), Bachelor’s degree or higher preferred.  
  • 3+ Years of experience in a healthcare paralegal role preferred.
  • Certification or willingness to obtain certification in Healthcare Compliance through the Healthcare Compliance Association (HCCA).
  • Strong sense of ethics with impeccable integrity
  •  Possess the ability to communicate with both written and oral skills.
  • Research, analytical, organizational, and computer skills
  • Possess the ability to plan and execute work projects in a detailed and organized manner.
  • Excellent interpersonal and communication skills with the ability to interact with individuals at all levels of the company, including senior executives.
  • Knowledge of health law and contract drafting experience is required
  • Proficiency in Microsoft Office, including Word and Excel; highly attentive to detail and able to handle large amounts of paperwork for a busy office; excellent organizational and time management skills; clear, concise, and logical writing style.
