Duties Position is Remote (Restricted)- The duty station can be the employees' home, however, must be located within the local commuting area of Washington, DC which has been established as 125 miles or 2.5 hours. The applicant would not be required to report to the DOE Worksite every pay period but will be required to do so with some regularity (e.g., a few times a month) for work that cannot be performed remotely.
The Department of Energy's (DOE) Office of the General Counsel is looking for a dynamic, innovative, seasoned executive to serve as the principal legal advisor to the Deputy General Counsel for Business Transactions.
As the Assistant General Counsel for Technology Transfer and Intellectual Property you will:
- Provide legal advice and counsel to Department managers and staff in all areas of Technology Transfer and Intellectual Property.
- Provide legal advice, assistance, interpretation, and counsel to senior Department managers and staff concerning the legal authority for and the legal implications of all activities.
- Provide legal advice and counsel to Department managers and staff in all areas of Technology Transfer and Intellectual Property, including the formulation of DOE's patent policy and representation of the Department's interests in intellectual property matters, including patents, trademarks, copyrights, trade secrets, and related matters.
- Conduct litigation involving intellectual property and technology transfer matters, including both court and administrative proceedings.
- Investigate and dispose of copyright and patent infringement actions against the Department as well as pursuing IP enforcement actions against entities that are in violation of their IP and/or U.S. manufacturing commitments.
- Prepare or review a wide variety of complex contractual instruments and negotiates and approves contract provisions and administers contract provisions and approves contract closeouts.
- Advise on probable impact of new or revised legislation, recommends action or proposed alternatives as appropriate and recommends an agency course of action.
- Provide direction to professional and technical staff performing legal work in the area of Technology Transfer and Intellectual Property.
- $193,819 - $221,900/year
PRE-HIRING REQUIREMENTS: This is a permanent position in the SES. Unless you are already a member of the SES with career status or are a graduate of an Office of Personnel Management (OPM) certified SES Candidate Development Program, your executive qualifications must be approved by OPM before you can be hired. If you are selected, you will be required to prepare your executive core qualification (ECQ) narrative for OPM submission.

BACKGROUND INVESTIGATION: You must pass a background investigation.
PUBLIC FINANCIAL DISCLOSURE REPORT (OGE 278): If you are selected for this position, you will be required to file this report prior to entry on duty in accordance with the Ethics of Government Act of 1978.
PROBATIONARY PERIOD: You must complete a one-year SES probationary period.
SECURITY CLEARANCE: You must be able to obtain and maintain a DOE Q-level security clearance.
DRUG TESTING: As a condition of appointment to this position, you will be subject to pre-employment/pre-appointment testing for illegal drug use under the U.S. Department of Energy Employee Drug Plan. MANDATORY TECHNICAL QUALIFICATIONS (MTQs): As part of your application package, aseparate document must be uploaded addressing each MTQ listed below. No more than one page per MTQ is allowed; additional information will not be considered. MTQs must provide specific examples that address relevant experience and accomplishments. Your leadership and management skills must be addressed in the MTQs listed below.

MTQ 2: Describe your experience with IP laws and regulations, particularly authorities governing IP in the context of Federal grants, contracts, cooperative agreements and "Other Transactions" (OT) agreements, as well as Partnership Intermediary Agreements (PIAs), and prize authorities; demonstrated experience leading or participating in contract reviews and negotiations and counseling clients on disposition of IP rights and other equities in connection with these agreements.
MTQ 3: Describe your knowledge of laws, regulations, orders, and policies governing technology transfer at Federal Laboratories, including authorities that govern cooperative research and development agreements (CRADAs), U.S. manufacturing requirements, user facilities, and sponsored research; demonstrated experience in negotiating technology transfer agreements, or developing or administering technology transfer policy guidance for a Federal agency.
