POSITION SUMMARY
 
The NHBP Prosecutor serves as the chief law enforcement officer of the Tribe and shall be responsible for supervising all criminal and civil infraction investigations of offenses arising under the Tribe’s laws and representing the Tribe in state and tribal child protection and vulnerable adult protection proceedings, as well as other associated duties. The primary duty of the prosecutor is to seek justice within the bounds of the law, not merely to convict. The prosecutor serves the public interest and should act with integrity and balanced judgment to increase public safety both by pursuing appropriate criminal charges of appropriate severity, and by exercising discretion to not pursue criminal charges in appropriate circumstances. The prosecutor should seek to protect the innocent and convict the guilty, consider the interests of victims and witnesses, and respect the constitutional and legal rights of all persons, including suspects and defendants.
 
ESSENTIAL FUNCTIONS
 
  1. Prosecution of crimes and civil infractions in the Tribal Court, which arise under the Tribe’s criminal and civil laws, including arraignments, motions, trials and appeals;
  2. Work closely with the Tribal Court Administrator and Tribal Judge(s) to improve the delivery of services within the Tribal Court and to assist the Court in case management and docket preparation;
  3. Establish a working relationship with local, state and federal jurisdictions to establish protocols for coordinating criminal investigations and prosecutions with the authority of such local, state and federal jurisdictions;
  4. Review all requests for arrest warrants and search warrants to determine if all constitutional requirements are satisfied prior to approval or authorization;
  5. Review all police reports and determine what, if any, charges to bring and whom to charge; draft charges and complaints of violations of Tribal criminal and civil laws;
  6. Consult with and advise the Tribal Police Department on all aspects of applicable criminal and civil investigations and prosecutions to ensure legal sufficiency and constitutional adherence;
  7. Upon designation as Special Assistant U.S. Attorney, prosecute non-Indian misdemeanor violations in federal courts;
  8. Work with various multi-disciplinary teams as part of the Tribal and applicable state justice systems to improve services, operations, outcomes;
  9. Coordinate with the Tribal probation department as needed for the administration of justice;
  10. Provide advice and recommendations to the Tribal Council and Chief Legal Counsel regarding the adoption of laws, or amendments to existing law, and intergovernmental agreements, which are reasonable or necessary to promote the health, safety and general welfare of the Tribal Community and Reservation;
  11. Serve as presenting officer in matters arising under the NHBP Elder/Adult Services and Protection Code (or any successor law), the Juvenile Justice Code (or any successor law), and/or child protection cases in the Tribal Courts and, at the request of Tribal Social Workers, to represent the Tribe in Indian Child Welfare Act cases involving children enrolled (or eligible for enrollment) with the Tribe arising in the state jurisdictions; and
  12. Significant travel to visit crime scenes, victims, experts, or other legal counsel, attend different court proceedings, participate in intergovernmental meetings, and attend trainings.
 
 
MINIMUM NECESSARY POSITION REQUIREMENTS
 
  1. Juris doctor degree (J.D.) from accredited law school.
  2. Must be a member of the State Bar of Michigan and NHBP Tribal Court, in good standing, and must not have had their license or admission to practice suspended or revoked in any jurisdiction.
  3. Working knowledge or experience in the practice of Indian law and statutes/common law affecting civil and criminal jurisdiction on Indian lands.
  4. Excellent communication skills, both verbal and written.
  5. Understanding of all codes and professional standards applicable to the conduct of prosecutors.
  6. Experience with juvenile welfare cases.
  7. Demonstrated experience working on complex legal projects with little or no direct supervision.
  8. Proficient in general computer skills and applications, including Microsoft Office suite.
  9. Ability to efficiently organize and present information in individual and group settings.
  10. Must have the ability to work evenings and/or weekend hours as necessary.
  11. Must have the ability to be contacted during non-business hours, including late nights and weekends, for consultation with law enforcement and warrant authorization.
  12. Must have a valid Driver License.
  13. Must pass a pre-employment Alcohol/Drug Test.
  14. Must pass a criminal background check.
 
 
Preferred Qualifications
 
  1. 3-Years Prior experience as a prosecutor within tribal jurisdiction.

Computer Skills                                           
To perform this job successfully, an individual should have knowledge of Internet software and Word Processing software.
