State of North Carolina See More Job Openings by This EmployerThis position is part of the Land, Groundwater, and Waste Section which represents and advises the following Divisions of the Department of Environmental Quality (DEQ) – the Division of Waste Management (DWM) and the Division of Energy, Mineral and Land Resources (DEMLR), and, in instances related to groundwater, the Division of Water Resources (DWR). This position may also be called upon to perform work in other sections within the Environmental Division. That representation includes all aspects of civil litigation, administrative contested case litigation, legal advice in non-litigation matters, and drafting administrative rules. The Section also prepares and argues criminal appellate cases, responds to inquiries and requests for legal assistance from the General Assembly, the Governor, and other public officials, and responds to public inquiries.
The primary purpose of this position is to provide a full range of legal services to the Section’s client, DWM, which administers and enforces the State’s solid and hazardous waste management laws and rules, regulates Underground Storage Tanks (UST), and oversees remediation of contaminated sites. The attorney in this position will specialize in representing DWM’s Brownfields Redevelopment Section and its Superfund Section, including that Section’s Inactive Hazardous Sites Branch, Pre-Regulatory Landfill Program, and Dry Cleaning Solvent Cleanup Act program among others. This position may be called upon to perform work in other sections within the Environmental Division.
Represents the Department in Civil and Administrative Litigation:
The attorney in this position independently represents the clients in all levels of civil litigation before State and federal courts, and before the North Carolina Office of Administrative Hearings. The attorney may also appear before other boards, agencies or commissions on behalf of the client agencies in regulatory matters that may result in litigation.
Responds to Inquiries from Client, the Public and Officials:
The attorney in this position responds to inquiries from the clients, the general public and public officials involving legal interpretation and application of statutes, rules and regulations to specific factual situations and as related to general policies and procedures, by conducting legal research and rendering opinions based on this research. The attorney must have the capability of researching and responding to more complex issues.
Prepare and Argue Criminal Appellate Cases:
The attorney in this position will be expected to represent the State in criminal cases on appeal from the Superior Court Division. These cases will involve complex issues of North Carolina criminal law as well as State and federal constitutional law and may involve cases of first impression.
THE STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO THE RECRUITMENT RANGE OF $73,208 to $89,119. Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.

Ability to conduct civil or criminal litigation.
Ability to interpret and apply constitutional provisions, statutes, administrative regulations, court decisions, and other precedents.
Ability to analyze facts, evidence, and legal instruments.
Minimum Education and Experience RequirementsLicensed to practice law by the North Carolina State Bar and one year of professional legal experience.
