The NC Department of Justice (NC DOJ) is looking for a leader, strategist, and partner to help us provide excellent representation and support to our client, the North Carolina Department of Labor (DOL). This position will be responsible for setting the tone and providing leadership and management for the NC DOJ's Labor Section. This work is precedent-setting and critical to ensuring that private employers and all State and local government agencies maintain a safe work environment for their employees. The Section is comprised of seven attorneys, a paralegal, and an administrative specialist. It is incumbent upon this position to have the ability to learn and develop a working understanding of the several regulatory acts enforced by DOL and have the ability to become an expert in the requirements and provisions of each of these acts. As a member of the management team, this position will be responsible for supporting the client and successfully balancing the needs of the NC DOJ and its initiatives.This position will act as advisor and legal representative to the DOL, including all of its divisions and bureaus, such as the Occupational Safety and Health Division; Human Resources Division; Boiler Safety Bureau; Elevator and Amusement Device Bureau (EAD); Wage and Hour Bureau; Retaliatory Employment Discrimination Bureau; Mine and Quarry Bureau; Consultative Services Bureau; Education, Training and Technical Assistance Bureau; and, Planning, Statistics and Information Management Bureau. The Section represents the DOL in all civil actions and administrative proceedings, including those involving the enforcement of the Occupational Safety and Health Act of North Carolina. In coordination with the Solicitor General's Office, attorneys in the Section handle cases from the trial stage and through all appellate stages. North Carolina is an Occupational Safety and Health Act (OSHA) – approved State Plan. With certain exceptions, DOL adopts federal OSHA standards; therefore, attorneys in the Section must gain command of the Federal Occupational Safety and Health Act of 1970, the Occupational Safety and Health Act of North Carolina, and the accompanying regulations and rules.This position is an excellent opportunity for an experienced civil litigator with management skills who wants to make a positive difference in North Carolina's workforce, and make a lasting impact on the everyday life of North Carolina citizens.
- Knowledge, Skills and Abilities / Competencies
- The Section Head must have the ability to learn and develop a working understanding of the several regulatory acts enforced by DOL and have the ability to become an expert in the requirements and provisions of each of these acts.Additionally, this position must have the:
- Ability to promptly make management and legal strategy decisions and promptly execute on those decisions.
- Thorough knowledge of case, statutory, regulatory, and common law.
- Ability to interpret and apply dense State statutory schemes with an overlay of Federal statutes, interpret and apply laws, constitutional provisions, statutes, administrative regulations, and court decisions.
- Ability to conduct complex civil litigation in specialized areas of law from the trial stage through the appellate stage.
- Ability to express conclusions and arguments clearly, concisely, and logically in oral and written form.
- Proven ability to use good judgment and discretion in performing one's job responsibilities and effectively collaborate with others throughout and outside of NC DOJ.
- Minimum Education and Experience Requirements
Licensed to practice law by the North Carolina State Bar and five years of progressively responsible professional legal experience. NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.

- Ability to independently develop creative solutions to legal issues and management challenges.
- Demonstrated ability to effectively collaborate with management, colleagues, team members, and clients.
- Ability to lead a team of specialized professionals effectively.
- Experience/knowledge in Occupational and Safety Health issues, employment law, and/or demonstrated ability to master technical areas of law.
- Experience independently litigating civil cases in a variety of forums, including administrative tribunals and State and Federal courts.
- Ability to multi-task and prioritize effectively, and lead others in the Section to the do the same.
