Job Description
The Litigation and Compliance Counsel handles non-employment litigation matters and provides various business units (Product Compliance, Quality Assurance, Merchandising, Marketing, Facilities/Real Estate, Store Operations) with strategic advice and legal counsel regarding potential legal issues.

- Provide practical and proactive legal advice and day-to-day support for cross-functional business partners on a broad range of topics including product safety and compliance (including compliance with CPSC, NHTSA, and other agency standards in addition to voluntary industry standards), marketing compliance (including comparative advertising, pricing issues, membership, and other marketing statements), retail store ADA and license and permitting compliance, and other compliance issues that may arise in a retail setting.
- Respond to and manage informal complaints from customers or competitors regarding sales and marketing practices.
- Respond to demands and manage outside counsel for non-employment litigation, including class actions, Prop. 65, ADA claims, landlord/tenant litigation, IP litigation, among others.
- Work with outside counsel regarding agency reporting and recalls relating to product safety and compliance.
- Manage discovery obligations and responses by collaborating with litigation paralegals to provide outside counsel with potentially relevant documents for litigation matters.
- Manage tracking of pending litigation matters, assigned outside counsel, case status, and potential exposure.
- Represent the company in mediations, depositions, and court, as needed.
- Keep informed of relevant regulations and case law and assist in advising the company on strategic, business-oriented compliance guidance.
