Job Description

The Pennsylvania Public Utility Commission (PUC) has openings for Assistant Counsel 2 (AC2) prosecutorial positions within the Rates Division of the Bureau of Investigation and Enforcement (I&E). The AC2 represents the public interest in ratemaking matters before PUC Administrative Law Judges by analyzing written documents such as rate filings, interrogatories, and testimony; coordinating a team of technical staff; and preparing briefs, memoranda, and relevant correspondence. Specifically, the AC2 will:

  • Analyze written documents such as rate filings, interrogatories, and testimony.
  • Coordinate a team of technical staff, and prepare briefs, memoranda, and relevant correspondence.
  • Develop a prosecutory strategy for discovery, testimony, cross-examination, and settlement negotiations as a lead attorney in rate filings under one million dollars and under the guidance of a senior attorney in rate filings over one million dollars.
  • Prepare research, analyses, and recommendations on a variety of issues involving formal and informal investigations, administrative procedures, evidence, and trial practice.
  • Work independently or with co-counsel to evaluate the relative merits of legal positions and to subsequently prepare data requests and negotiate settlement agreements, or, if proceeding to litigation, prepare interrogatories, present witnesses and exhibits, cross-examine witnesses, and analyze evidence, and litigate before PUC Administrative Law Judges.
  • Prepare and file motions, briefs, exceptions, and other pleadings as necessary for the prosecution of cases.

Work Schedule and Additional Information:

  • Full-time employment
  • Work hours are 8:00 AM to 4:30 PM, Monday - Friday, with a 60-minute lunch.
  • Telework: You may have the opportunity to work from home (telework) part-time. In order to telework, you must have a securely configured high-speed internet connection and work from an approved location inside Pennsylvania. If you are unable to telework, you will have the option to report to the headquarters office in Harrisburg. The successful candidate is required to report to the headquarters worksite daily, unless the employee meets eligibility requirements and telework has been approved. Management may discontinue any telework arrangement at any time, for any reason.
    • Within a reasonable travel distance of Harrisburg; and
    • Within the Commonwealth of Pennsylvania.

    Qualifications

    Minimum Experience and Training Requirements:

    • Two years of progressively responsible experience in professional legal work which provided exposure to governmental regulatory law (preferably regarding public utilities), and/or administrative law and graduation from an approved school of law; or
    • Any equivalent combination of experience and training.

    Additional Requirements:

    • You must have experience in governmental regulatory law and public utilities.
    • You must have possession of a certificate of admission to the Bar of the Supreme Court of Pennsylvania, or be eligible for a certificate of admission to the Bar of the Supreme Court of Pennsylvania.
    • You must have possession of a certificate of admission to the bar of the highest court of another state, with preparatory steps taken to become a member of the Bar of the Supreme Court of Pennsylvania.
    • Demonstrated experience with litigation in administrative and/or regulatory cases (preferably in PUC jurisdictional matters).
    • You must be able to perform essential job functions.
