This Corporate Counsel role is responsible for advising clients on the legal aspects of marketing, advertising, and selling consumer products and services globally. Prior experience representing marketers in the development of consumer-facing claims and substantiation, competitor challenge practice before the NAD, responding to threatened and filed consumer protection class actions, and the legal aspects of designing advertising content and media campaigns is required. Knowledge of global sustainability advertising developments and best practices is required. Experience with laws and regulations impacting pesticides, antimicrobials, over-the-counter drugs, and cosmetics is preferred. Preference given to large law firm plus in-house experience.
Essential Duties and Responsibilities:
- Review global advertising and communications materials for compliance with applicable laws, company policy, and brand requirements. Analyze and advise clients on advertising claim substantiation requirements, including development of data for comparative performance claims.
- Initiate and defend advertising claims in NAD challenges or court cases, retain and oversee local counsel’s representation of clients in similar challenges in international markets (ex. UK’s ASA, Argentina’s CONARP), and manage company’s defense to threatened or filed consumer class action litigation.
- Advise global marketing teams on online advertising practices for social media platforms and e-commerce product detail pages, paid and organic search, app and content creation, influencer engagement, and compliance with disclosure requirements and endorsement guidelines.
- Negotiate and draft joint promotion, brand in- and out-licensing, confidentiality, entertainment, event, sponsorship, spokesperson, and other agreements related to the advertisement and marketing of consumer products and services.
- Identify and facilitate internal policy creation, update, and implementation, including contributing to SCJ’s internal advertising/marketing policies and procedures.
- Create and present client seminars, education, and training on relevant legal and compliance issues, such as advertising and marketing laws, sales practices, regulatory compliance, personal data and privacy compliance, and sustainability topics.
- Collaborate with colleagues to identify and analyze legal issues, develop and effectively communicate sound, understandable legal and business recommendations to the appropriate business managers, ensuring consistent messaging on similar legal issues across brands and business categories.
- Advise the business on the legal and regulatory requirements of global pesticide, antimicrobials, over-the-counter drug, personal care products, and cosmetic laws.
- Select, retain, and work collaboratively with outside counsel.
Required Skills / Experience / Competencies:
- JD degree and admitted to practice law in a US state and of good standing along with
- Minimum 8 years of legal practice in a large law firm and/or as in-house counsel (internships and summer associate time will be considered)
- Experience with applicable federal and state marketing and advertising laws and regulations, and experience with advertising self-regulatory bodies
Preferred Skills / Experience / Competencies:
- Experience in research and advising company personnel of the regulatory and legal requirements of US and global advertising and marketing laws is mandatory
- Experience in global Food, Drug (over the counter) and Cosmetic laws is desirable
- Experience in global Pesticide or biocide registration and regulations is desirable
- Must exercise sound judgment, be able to work efficiently and independently under time pressures and deadlines in a fast-paced, demanding environment
- Comfortable independently handling a wide variety of matters including novel issues in evolving areas of business and law
- Ability to work confidently and collaboratively toward effective and harmonious interactions with other attorneys and with the company's technical and business personnel
- Outstanding analytical, consulting, drafting, and negotiation skills with the ability to make well-reasoned legal and business judgment
- Excellent oral and written communication skills, with the ability to negotiate contracts and settlements, and to influence or persuade others
- Proven ability to prioritize and manage projects or requests appropriately and effectively from several client groups
- Strong leadership skills and results-orientation
- Willingness to learn new areas of law, acquire new skills, and take on additional responsibilities
- This role is eligible for domestic relocation
