Job Description

Nature of Work

The Office of the City Attorney for the City of Miami Beach is seeking a transactional attorney to handle all aspects of contracting for the City’s Procurement Department and to provide other legal advice and support to other City departments, as necessary. 

Illustrative Examples of Essential Duties

  • Drafts and review City transactional documents including service agreements, professional services agreements, independent contractor agreements, leases, management agreements, license agreements, easements, restrictive covenants, indemnification agreements, grant agreements, settlement agreements, Procurement related documents, construction related agreements, and other administrative documents or agreements, resolutions, restrictive covenants, contracts, and other legal instruments.
  • Advises City personnel in regard to the Sunshine Law and Public Records Act.
  • Conducts legal research and analysis and drafts memoranda of law on a range of issues relating to Florida Procurement law and municipal government law.
  • Advise various City departments, including Housing, Parks and Recreation, Tourism and Culture, Economic Development, Communications, Grants, Public Works, Capital Improvement Projects, Information Technology, Sustainability, and Human Resources, on transactional matters.
  • Advise the Procurement Management Department on bid protests, the procurement process for various goods and services, and general compliance with Florida procurement law. 
  • Draft bid protest responses and represent the City in procurement-related disputes. 
  • Review and draft City Commission resolutions and ordinances on procurement-related or general business matters.

Minimum Requirements

  • Graduation from an accredited school of law.
  • Demonstrated interest and/or 4-6 years of experience relevant to transactional law and/or procurement law.
  • Membership in the State Bar of Florida.
  • Other combinations of experience and education that meet the minimum requirements may be substituted.

PHYSICAL REQUIREMENTS:

  • The work is typically performed in an office and in court rooms and meeting rooms while sitting at a desk or table while intermittently sitting, standing, or stooping.  The employee occasionally lifts light objects
  • Must have the use of sensory skills in order to effectively communicate and interact with other employees and the public through the use of the telephone and personal contact
  • Physical capability to effectively use and operate various items of office related equipment, such as, but not limited to, personal computer, calculator, copier, and fax machine

  • Ability to establish and maintain effective working relationships with elected officials, coworkers, the press the general public and members of diverse cultural and linguistic backgrounds regardless of race, religion, age, sex, disability, political affiliation, gender identity or sexual orientation.  
  • Ability to serve the public and fellow employees with honesty and integrity in full accord with the letter and spirit of all city ethics and conflicts of interest policies. Strong understanding of ethical behavior is required.  
  • Ability to maintain regular and punctual attendance.  
  • Performs related work as required.  
  • Reports to work as directed during an emergency as an essential employee of the City of Miami Beach.

  • Ability to develop innovative and creative solutions to issues consistent with the City’s strategic plan.
