The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the State of North Carolina in court and provides legal advice and representation to most state government departments, agencies, officers, and commissions. The Department also represents the State in criminal appeals from state trial courts, and brings legal actions on behalf of the state and its citizens when the public interest is at stake.
The Tort Claims Section of the N.C. Department of Justice represents the various State agencies subject to suit pursuant to N.C. Gen. Stat. § 143-291, et seq.
The primary duty of this attorney is to represent the North Carolina Department of Adult Correction (DAC) in all litigation matters that arise under N.C.G.S. § 143-291. These responsibilities include investigation of claims, drafting of responsive pleadings, conducting discovery, attendance at all pretrial hearings, trials, and appellate. The attorney will be required to travel to those locations where the various litigation endeavors are conducted.
This position is responsible for defending civil actions for serious personal injury, wrongful death, medical malpractice or property damage brought against State employees individually pursuant to the Defense of State Employees Act, N.C.G.S. § 143-300.2, et seq.
Criminal appeals:
This attorney handles criminal briefs on appeal by the defendant to the North Carolina Court of Appeals and the Supreme Court. The attorney reviews the trial transcript, researches applicable law and files the brief in accordance with the Rules of Appellate Procedure. If decisions made by the Court of Appeals are appealed, the attorney follows the matter through to final disposition by the Supreme Court. If a case is selected for oral argument by the Court of Appeals or the Supreme Court, the attorney represents the State at the oral argument.
This position is not subject to the Fair Labor Standards Act.
This position requires travel and overnight travel.
