The Chief Deputy General Counsel is a senior legal advisor for the North Carolina Department of Public Safety. The Chief Deputy is responsible for providing legal advice, liability prevention strategies, and risk management services for the Department. This position is a member of the executive management team, and works with executive management to develop or refine short and long-term plans concerning any facet of agency operations. 

Job duties for this position include:
  • Providing legal assistance for constitutional, unique, and/or complex legal issues including issues without legal precedent, to include conducting factual research; analyzing information; rendering formal opinions; and creatively developing case strategies, arguments, and litigation strategies
  • Negotiating on behalf of the agency, including reviewing and drafting legal documents, opinions, legislation, and administrative rules
  • Maintaining an in-depth knowledge of agency operations and programs
  • Providing expertise in all relevant fields of law including statutory, case, and regulatory law
  • Serving as second in command for the General Counsel and providing critical back-up coverage to the General Counsel on department-wide legal and policy matters
  • Overseeing the daily operations of the General Counsel's Office including planning and supervising legal matters assigned to all General Counsel attorneys
  • Supervising all Deputy General Counsels and Assistant General Counsels within the Office of General Counsel 
This position requires the ability to:
  • Plan and support the development of others, including serving as a coach or mentor to other attorneys
  • Coordinate and facilitate work teams consisting of multiple attorneys and other staff
  • Determine skills of work teams and monitor teams' progress in assigned tasks to ensure objectives are accomplished
  • Interpret and apply laws, constitutional provisions, statutes, administrative regulations, and court decisions
  • Investigate complex legal claims and formulate defenses 
  • Assist DOJ in legal cases related to DPS including preparation and organization of witnesses and exhibits, and preparation of persuasive appellate briefs and other appellate documents in cases involving a variety of complexity of facts or issues
  • Understand the role of DPS as an agency and the services provided to clients and the State
  • Draft statutes and rules and amendments which have a broad impact on client programs, or which create new programs

About the Office of the General Counsel:
The Office of the General Counsel (OGC) provides to executive management and managers oral and formal written legal opinions on laws, constitutional provisions, administrative rules and regulations, court decisions, and other precedents impacting the department's policies and operational procedures. This section drafts departmental rules and regulations, operational guidelines, contracts, department-sponsored legislation, and other legal documents. Attorneys in the OGC provide oral and written responses to inquiries by federal, state, and local officials including legislators, judicial officials, law enforcement personnel, and citizens about the department's policies and practices and the statutes and regulations it enforces. The OGC advises the Secretary and executive management on the merits of litigation against or on behalf of the department.

To qualify for this position, applicants must demonstrate ALL of the following KSAs:


  • Experience analyzing complex and/or novel legal problems and rendering formal opinions or responses

  • Experience managing staff, including planning the work of others and supporting staff development

  • Experience drafting statutes, rules, and/or amendments 

Minimum Education and Experience Requirements

Licensed to practice law by the North Carolina State Bar and four years of progressively responsible professional legal experience.
