This attorney is the attorney within the section that works most closely with the North Carolina Sheriffs’ Education and Training Standards Commission, and secondarily with the North Carolina Criminal Justice Education and Training Standards Commission. The attorney attends the Commissions’ meetings, advises them on a wide range of legal issues, and represents them in civil and administrative proceedings, including officer decertification cases and state and federal civil litigation against the Commissions. This position also bears primary responsibility for representing the Alcoholic Beverage Commission, including in civil and administrative litigation in state and federal court.
Although criminal prosecution is not the primary focus of this position, this attorney may also handle some trial level criminal cases and will certainly handle criminal cases on appeal through the brief rotation. Additionally, this attorney may be called upon to instruct legal courses for the North Carolina Justice Academy or other law enforcement trainings.
The attorney is responsible for providing day-to-day legal advice for police departments, sheriffs’ offices and other law enforcement agencies across the State on a day-to-day rotational basis with other attorneys assigned to the Section. This attorney devotes a substantial portion of his time to answering these inquiries for legal assistance and advice. The requests for legal advice involve numerous and varied areas of law, to include: (1) Arrests; (2) Search and Seizure; (3) Elements of Criminal Offenses; (4) Civil Liability; (5) Courtroom Security; (6) Civil Process; (7) Motor Vehicle Laws; (8) Personal Matters; (9) Criminal Procedure; (10) Emergency Vehicle Operation; (11) Use of Deadly Force; (12) Jurisdiction of Various Law Enforcement Agencies and other legal issues too numerous to include herein.
This position is not subject to the Fair Labor Standards Act.
This position requires travel and overnight travel.

This position qualifies for Teleworking on a part-time basis and is flexible / hybrid, subject to management approval.

Section Information:
The Special Prosecutions and Law Enforcement Section supports and provides legal advice to District Attorneys and law enforcement across the State in addition to representing the State of North Carolina in both criminal and civil litigation.
Pursuant to N.C.G.S. § 114-11.6, the attorneys in this Section are authorized to prosecute or assist in the prosecution of criminal cases when requested to do so by a District Attorney and the Attorney General approves. Attorneys assigned to this Section will prepare and try complex and significant criminal cases independently and with a high level of expertise. Most frequently, attorneys will assume responsibility for a case when a District Attorney makes a request pursuant to his or her conflict of interest. Additionally, attorneys will handle cases that require special expertise or resources that the DA’s Offices do not have available. The types of cases most often include homicide, public corruption, drug trafficking and wiretaps, and white-collar crime.
The Section also provides legal advice and technical assistance to police departments, sheriffs’ departments, state law enforcement agencies, city and county attorneys, city and county managers, various other city and county personnel, district attorneys, police legal advisors, and members of the General Assembly.

Knowledge, Skills and Abilities / Competencies
Ability to obtain extensive knowledge of federal and state case law, statutory law and administrative rules and regulations.
Ability to obtain comprehensive knowledge of arrests, search and seizure statutes and case law at both the federal and state levels.
Ability to obtain knowledge of the progression of the criminal justice professional entry level, in-service and training standards in North Carolina.
Ability to learn the role and responsibilities of the Criminal Justice Standards Commission and its predecessor council as it relates to the Company Police Program.
Ability to communicate complex legal concepts in a simple, common-sense manner.
Ability to translate observations into legal teaching points.
Ability to obtain considerable knowledge of judicial and quasi-judicial procedures.
Ability to assist with courtroom litigation and to independently conduct courtroom litigation.

Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience. NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.
